L’Oréal in court against eBay in counterfeiting accusations, decision to be made 29 April

PARIS, 8 April 2009 (AFP) – The court has pushed the date for its decision in the hearing regarding forgery claims by L’Oréal against American online sales website eBay back to 29 April.




In 2007 L’Oréal lodged complaints in five different countries against eBay for forgery, stating that “fake perfumes and fake cosmetics” were being sold on the site.

eBay won the legal battle in Belgium in August 2008, the first of the five accusations to be settled. The Belgian courts judged that eBay did “not have an obligation to carry out systematic surveillance” of what was being sold on its site.

A similar case in the USA against the American jeweler Tiffany also found in favour of eBay in July 2008.

On the other hand, the internet auction site was found guilty by French courts last July and ordered to pay more than €38 million to the global leader in luxury products, LVMH, following the sale of counterfeit bags, perfume and clothes. eBay has appealed the decision.
